Terms and Conditions

These Premier Loyalty Club Terms and Conditions ("Premier Club Terms") govern your participation in Premier Loyalty Club. The Premier Loyalty Club benefits are issued and administered by Premier USA, Inc. ("Premier USA, Inc.," "Premier Dead Sea," "we," "us," and "our").. By signing up for the Premier Loyalty Club and purchasing a membership (a "Premier Club Membership"), you agree to comply with these Terms and acknowledge that these Terms are subject to www.premierdeadsea.com’s  Site User Terms and Conditions and Privacy Policy, which are incorporated herein.
We reserve the right to limit, modify, alter, waive, or cancel the Premier Loyalty Club at any time, prospectively or retroactively, with or without notice.

BENEFITS

• Receive 10% discount on every eligible purchase. From time to time, Premier USA, Inc. may run special promotions which permit you to earn additional Premier Loyalty Club discounts and benefits.
• Free standard shipping within the continental United States on all orders.
• Access to www.premierdeadsea.com exclusive Club member shopping events.
• Premier Loyalty Club discounts may be used and combined with other discounts and coupons for eligible purchases.

CONDITIONS

• You must be 18 years of age or older to obtain a Premier Loyalty Club Membership.
• Your participation in the Premier Loyalty Club is revocable by us at any time, at our sole discretion.
• You may have only one Premier Loyalty Club Membership per email account.
• For any benefit to apply, your Premier Loyalty Club Membership must be active at the time of purchase. You will not be reimbursed retroactively for purchases made while your Premier Loyalty Club Membership is inactive or expired.
• Your Premier Loyalty Club Rewards Membership is non-transferable.

ELIGIBLE PURCHASES

Your Premier Loyalty Club membership benefits are available only for purchases made online at www.premierdeadsea.com or over the phone at 866-594-7546.
Reward Dollars are not transferrable, have no cash value, and are not redeemable for cash.

PREMIER LOYALTY CLUB
REWARDS MEMBERSHIP FEE
The annual Premier Loyalty Club Membership fee is $29.95. We may change the Membership fee or run special promotions at any time, but changes will apply only to new or renewed memberships. The Premier Loyalty Club Membership fee is non-refundable, except as set forth herein. We will waive the Premier Loyalty Club Membership fee for the Premier Loyalty Club as set forth herein.

TERM

The initial term of your Premier Loyalty Club Membership will commence on the date it is purchased and continue for 1 year, unless terminated.

YOUR PREMIER LOYALTY CLUB MEMBERSHIP WILL AUTOMATICALLY RENEW ON THE ANNUAL ANNIVERSARY OF THE DATE YOU SIGNED UP FOR YOUR PREMIER LOYALTY CLUB MEMBERSHIP.
 TO OPT OUT OF THIS MEMBERSHIP FEATURE, SIMPLY CALL OUR CUSTOMER SERVICE DEPARTMENT AT 866-594-7546 AND ASK TO OPT OUT OF THE CLUB RENEWAL. UNLESS YOU NOTIFY US BEFORE RENEWAL THAT YOU WANT TO CANCEL OR DO NOT WANT YOUR PREMIER LOYALTY CLUB MEMBERSHIP TO AUTOMATICALLY RENEW, YOU UNDERSTAND AND AGREE THAT YOUR PREMIER LOYALTY CLUB MEMBERSHIP WILL AUTOMATICALLY RENEW AND YOU AUTHORIZE US TO COLLECT THE THEN-APPLICABLE ANNUAL MEMBERSHIP FEE USING ANY CREDIT CARD WE HAVE ON RECORD FOR YOU.

PAYMENT

Unless waived as set forth herein, your Premier Loyalty Club Membership fee will be billed to the method of payment that is active in your account.

PREMIER LOYALTY CLUB MEMBERSHIP CANCELLATION

You have the right to cancel your Premier Loyalty Club Membership at any time. No refunds will be given (unless we terminate or materially modify the Premier Loyalty Club Program; see Program Termination or Material Change below). You can cancel your Premier Loyalty Club Membership by (i) calling us at 866-594-7546. (Members located outside of the U.S. should call 954-318-3053); or (ii) contacting us via e-mail info@premierdeadsea.com.

DISCLAIMERS; LIMITATION OF LIABILITY

THE PREMIER LOYALTY CLUB PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.PREMIER USA, INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES ("PROVIDERS") DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT IN ANY WAY RELATED TO THE PREMIER LOYALTY CLUB. PROVIDERS MAKE NO WARRANTY THAT THE (i) PREMIER LOYALTY CLUB REWARDS PROGRAM WILL MEET YOUR REQUIREMENTS, OR (ii) PREMIER LOYALTY CLUB MEMBERSHIP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. IN NO EVENT WILL PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED THE PREMIER LOYALTY CLUB, INCLUDING BUT NOT LIMITED TO YOUR USE OR INABILITY TO USE THE PREMIER LOYALTY CLUB OR UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR PREMIER LOYALTY CLUB MEMBERSHIP DATA. NOTWITHSTANDING ANYTHING TO THE CONTRARY, PROVIDERS' TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WILL NOT EXCEED THE LAST ANNUAL PREMIER LOYALTY CLUB MEMBERSHIP FEE YOU PAID. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF MAY NOT APPLY TO YOU.

GOVERNING LAW

These Premier Loyalty Club Terms, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with, the laws of the State of Florida, without regard to conflict of law principles.

BINDING ARBITRATION

Any controversy or claim arising out of or relating to these Premier Loyalty Club Terms (including any breach thereof) or the Premier Loyalty Club Rewards Program shall be settled by confidential arbitration in Bonita Springs, Florida and administered by the American Arbitration Association under its Commercial Arbitration Rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated with any claim or controversy of any other party. The foregoing shall not preclude Premier USA, Inc. from seeking any injunctive relief in State or Federal courts.

NON-MATERIAL CHANGES TO THESE PREMIER LOYALTY CLUB TERMS

We may make non-material changes to these Premier Loyalty Club Terms at any time by notifying you of such change by email or by posting that changes have been made. Any such change shall take effect 30 days from the date of our notice. Your payment of the Premier Loyalty Club Membership fees or continued use of the Premier Loyalty Club after any change has been made constitutes your acceptance to the modified terms.

MATERIAL CHANGES OR PROGRAM TERMINATION

We may terminate or make material changes to any or all benefits available to you under the Premier Loyalty Club Program at any time with or without notice. In the event of our termination of or material change to the Premier Loyalty Club, at our election, we will, in our sole discretion, either maintain your Premier Loyalty Club Membership with your existing benefits until expiration of your current term or refund you a pro-rata portion of your Premier Loyalty Club Membership fee for the remaining full months of your current Premier Loyalty Club Membership term.
